These Terms govern your use of bde.online and the services of Boat Damage Experts Inc. (“B.D.E”). By using the site or requesting an estimate, you agree to them. Please read the disclaimers — they define what B.D.E is and, just as importantly, what it is not.

What B.D.E does

B.D.E produces itemized marine damage repair estimates from photographs and vessel information you provide, connects you with independent repair shops, and provides tools to help you organize and submit an insurance claim. We also sell marine engines, parts, and repair materials.

What B.D.E is not

B.D.E is not an insurance company, an insurance agent, or an insurance adjuster. We do not issue policies, determine coverage, adjust losses, or decide what your insurer will pay.

B.D.E is not a public adjuster and does not act as your representative in negotiating a claim with your insurer. We provide software, an estimate, and document-preparation tools. You remain the claimant. Where our tools help transmit a claim, that claim is sent by you, from your own email account, after you have reviewed and authorized it. We do not negotiate on your behalf, and our fees are never a percentage of any insurance settlement or claim payment.

B.D.E is not a law firm and provides no legal advice.

B.D.E is not the repair contractor. Repair shops on our exchange are independent businesses. They — not B.D.E — perform the work, control it, and are responsible for its quality, their licensing, insurance, and warranties.

Estimates

An estimate is our good-faith projection of repair cost based on the photographs and information supplied. It is not a bid, a fixed price, or a guarantee. Actual cost commonly changes once a repair professional physically inspects the vessel — hidden damage, moisture intrusion, and substrate condition are frequently not visible in photographs. An estimate does not guarantee that your insurer will approve, cover, or pay any amount.

Estimate accuracy depends on the accuracy and completeness of what you give us. Submitting inaccurate or incomplete information, or photographs that do not depict your vessel and its actual damage, will produce an unreliable estimate.

Your responsibilities

Sending a claim from your own email account

If you use our optional feature to send a claim from your own email account, you authorize B.D.E to transmit that specific message on your instruction. You confirm the message and its attachments are accurate before authorizing the send. You are the sender of that message; B.D.E is copied so we can track the claim on your behalf. You may revoke this authorization at any time.

Repair shops

Shops apply, are reviewed, and may be approved to receive jobs. B.D.E does not guarantee any shop’s work, licensing, insurance, timeline, or availability, and is not a party to your repair contract with a shop. Shop ratings and scores are informational only. Disputes about repair work are between you and the shop, though we will help where we reasonably can.

Fees and payment

Fees for our services are disclosed to you before you incur them and are charged as flat or quoted amounts for defined work — never as a percentage of an insurance claim or settlement. Payments are processed by a third-party processor subject to its own terms. Parts and engine sales are governed by our Return & Refund Policy. Fees for services already performed are non-refundable except where required by law or where we have made an error.

Intellectual property

The site, the estimating system, our pricing models, and all related software and content are owned by B.D.E and protected by law. You may not copy, scrape, reverse-engineer, or resell them, or use them to build a competing service.

You keep ownership of the photographs and information you submit. You grant B.D.E a license to use them to provide the services, and to create de-identified data.

Acceptable use

Do not use the site unlawfully, attempt to breach its security, access accounts that are not yours, scrape it by automated means, or interfere with its operation.

Disclaimer of warranties

The services are provided “as is” and “as available.” To the fullest extent permitted by law, B.D.E disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or that any estimate will match final repair cost or any insurance payment.

Limitation of liability

To the fullest extent permitted by law, B.D.E will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of use, arising from your use of the services — even if advised of the possibility. Our total liability for any claim relating to the services will not exceed the greater of the amount you paid B.D.E in the twelve months before the event or one hundred dollars ($100). Some states do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

You agree to indemnify and hold B.D.E harmless from claims arising out of your misuse of the services, your violation of these Terms or the law, or the inaccuracy of information you submit.

Termination

You may stop using the services at any time. We may suspend or terminate access for violation of these Terms, suspected fraud, or risk to the service or other users.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you and B.D.E each consent to that jurisdiction.

Changes

We may update these Terms. Material changes will be posted here with a new date. Continuing to use the services after a change means you accept it.
